TWO FELONS CHARGED WITH DISCHARGING FIREARM AND RESISTING ARREST AFTER UNLAWFULLY PARKING IN CAMPSITE IN DANA POINT

NEWPORT BEACH, Calif. – Two felons have been charged with discharging a firearm and resisting arrest after having unlawfully parked in a campsite in Dana Point. Rene Joseph Bolduc, 41, Brehnan, Texas, and Theresa Nannette Kirkland, 46, Huffman, Texas, are each charged with one felony count each of discharging a firearm with gross negligence, possession of a firearm by a felon, possession of ammunition by a prohibited person, and resisting and deterring an executive office. Bolduc is also charged with one misdemeanor count of reckless driving and has a prior conviction in 2014 for evading arrest or detention in Texas. Kirkland also has a prior conviction for driving under the influence with a prior conviction in 2011 in Texas. If convicted on all counts, Bolduc faces a maximum sentence of six years in state prison and Kirkland faces a maximum sentence of five years and four months in state prison. They are both in custody on $100,000 bail and are scheduled to appear in court tomorrow, Dec. 18, 2015, for a pre-trial hearing at 8:30 a.m. in Department H-7, Harbor Justice Center, Newport Beach.

At approximately 9:00 p.m. on Dec. 8, 2015, Bolduc and Kirkland are accused of parking in a Ford Explorer SUV at a campground near Doheny State Beach in Dana Point. The defendants are accused of parking in the campsite without paying or receiving the required registration to use the campsite. Bolduc and Kirkland are accused of having firearms in the vehicle.

At approximately 9:25 p.m. that day, a California State Park ranger was performing a routine check of the area to ensure that all of the vehicles at the site were parked lawfully, and approached Bolduc and Kirkland's vehicle. The defendant's are accused of being asleep in the vehicle when the ranger approached to verify if the defendants had the proper permits to park in the campsite. Bolduc is accused of driving away from the ranger while he was checking the defendant's identification. Bolduc is accused of hitting a concrete fire ring with the vehicle, causing the vehicle to flip onto its side.

The defendants are accused of firing a firearm and fleeing the scene. The Orange County Sheriff's Department, with the assistance of California Highway Patrol set a perimeter in the area and located Bolduc near a jetty in Dana Point Harbor and Kirkland near a lifeguard tower. The defendants were subsequently arrested.

Senior Deputy District Attorney Cynthia Nichols of the Special Prosecutions Unit is prosecuting this case.
