PENINSULA AREA MOTHER AND DAUGHTER CHARGED WITH NINE COUNTS OF TAX EVASION

Failed to Report Over $1,000,000 of Income

SAN FRANCISCO – Maria Virginia Reyes and Christine Reyes were indicted by federal grand jury in San Francisco on nine counts of tax evasion, United States Attorney Joseph P. Russoniello and Special Agent in Charge, IRS Criminal Investigation, Scott O’Briant announced.

According to the indictment, Maria Virginia Reyes, 60, and Christine Reyes, 36, are charged with willfully attempting to evade and defeat a large part of the income tax due and owing by under-reporting income on their U.S. Individual Income Tax Returns, Forms 1040. For the calendar years 2003 through 2007. Maria Virginia Reyes omitted total taxable income of $683,802.00, upon which she owed additional income tax of $193,247.00. For the calendar years 2003 through 2006, Christine Reyes omitted total taxable income of $344,989.00, upon she owed additional income tax of $88,822.00.

Maria Virginia Reyes and Christine Reyes were arrested and made their initial appearance in federal court in San Francisco on March 15, 2010. Both defendants were released on an appearance bond. The defendants are scheduled to appear on March 25, 2010 for trial setting before Judge Vaughn R. Walker, in San Francisco, California.

The maximum statutory penalty for each count of tax evasion in violation of 26 U.S.C. § 7201 is five years imprisonment and a fine of $250,000. However, any sentence following conviction would be imposed by the court after consideration of the U.S. Sentencing Guidelines and the federal statute governing the imposition of a sentence, 18 U.S.C. § 3553.

Thomas Moore is the Assistant U.S. Attorney who is prosecuting the case with the assistance of Kathy Tat. The prosecution is the result of an investigation by the Internal Revenue Service, Criminal Investigation.

Please note, an indictment contains only allegations against an individual and, as with all defendants, Maria Virginia Reyes and Christine Reyes must be presumed innocent unless and until proven guilty.
