PUBLISHER OF BAY AREA NEWSPAPERS PLEADS GUILTY TO FILING FALSE TAX RETURNS
Failed to report income from newspapers
OAKLAND, Calif. – Harry Warren Green pleaded guilty today to filing false federal tax returns for 2000 - 2003, United States Attorney Joseph P. Russoniello and Special Agent in Charge, IRS Criminal Investigation, Scott O’Briant announced. The guilty plea was followed by a sentence and order of restitution issued by United States District Court Judge Sandra Brown Armstrong.
According to the plea agreement, Green admitted to operating several newspapers in the Bay Area, including the Clayton Pioneer, Brentwood Bee, Bethel Islander, and the Oakley Herald. Green admitted in his plea that he under-reported income that he received while operating these newspapers. Documents filed with the court also state that Green failed to account for all of the income received while operating those businesses, real estate commissions he received, and income received from the sale of the Clayton Pioneer newspaper in 2003. Court documents state that Green cashed the checks, rather than depositing the funds, so his bank account did not reflect the income. Green’s intent to conceal the income for the express purpose of evading payment of federal taxes was confirmed by a bank employee and one of his co-workers.
Green was sentenced to five-months incarceration, five-months community confinement, ordered to pay $75,005 in restitution for filing false tax returns, and order to pay a $2,000 fine. Green is ordered to surrender on or before June 4, 2010.
Thomas Newman is the Assistant U.S. Attorney who is prosecuting the case with the assistance of Kathy Tat. The prosecution is the result of an investigation by the Internal Revenue Service Criminal Investigation.
