FEDERAL SENTENCING

In January 2005, the United States Supreme Court held in U.S. v. Booker that the federal sentencing guidelines were no longer mandatory, but merely advisory, based on principles of the Sixth Amendment. Since the decision, the United States Sentencing Commission has issued quarterly statistics that indicate, among other things, the degree to which judges have exercised their new authority to depart from the previously mandatory guidelines. So far, federal judges have departed below the mandatory guideline ranges in approximately ten percent of cases.

THE FEDERAL CRIMINAL TRIAL

 After the discovery process concludes and all the pretrial motions have been made, it is time to select a jury.

Jury Selection A criminal defendant's right to a trial by an impartial jury is guaranteed by the Sixth Amendment to the United States, which states in pertinent part "In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed."
The procedure for obtaining this impartial jury is found in the Federal Rules of Criminal Procedure [hereinafter FRCrP].
