CHILD CARE LEADER CONVICTED OF MOLESTING TWO YOUNG BOYS HE MET THROUGH SCHOOL DAYCARE PROGRAM

SANTA ANA - An after-school child care leader was convicted today of molesting two young boys during program hours while entrusted to care for them at an afterschool daycare program. Scott Andrew Christensen, 28, Rancho Santa Margarita, was found guilty by a jury of three felony counts of lewd acts on a child under the age of 14 years with sentencing enhancement allegations for substantial sexual conduct with a child and committing the sexual acts against more than one victim and mandatory lifetime sex registration. Christensen faces a maximum sentence of 45 years to life in state prison for this case.

Christensen was previously convicted in 2008 of two felony counts of lewd acts on a child under the age of 14 years with a sentencing enhancement allegation of substantial sexual conduct with a child who was under 14 years old and faces 10 years in state prison for that case.

He faces a maximum sentence of 55 years to life in state prison for both cases and his sentencing is scheduled for June 1, 2012, at 9:00 a.m. in Department C-37, Central Justice Center, Santa Ana.

Circumstances of the Case
At the time of the crimes, Christensen was a 6-year employee as a Child Care Leader at The Learning Connection (TLC), an after-school daycare program hosted by the Saddleback Valley Unified School District at elementary schools in Southern California.

SEX OFFENDER SENTENCED TO SIX YEARS IN PRISON FOR MOLESTING 5-YEAR-OLD BOY IN PUBLIC RESTROOM

SANTA ANA - A registered sex offender was sentenced today to six years in state prison for molesting a 5-year-old boy in a public restroom. Nicholas James Needham, 28, Laguna Beach, pleaded guilty Oct. 14, 2011, to one felony count of lewd acts on a child under 14. The defendant was sentenced in absentia, as he is currently in federal custody (see below).

At approximately 12:45 p.m. on June 15, 2010, Needham entered a men’s restroom at the Outlets at Orange (formerly known as the Block at Orange). A 5-year-old boy, John Doe, was using the urinal while his mother waited outside. Needham stood next to the victim, reached over, and touched the victim’s penis. The defendant then left the scene. Needham and the victim did not know each other.

John Doe disclosed the sexual assault to his mother, who contacted the Orange Police Department (OPD). OPD investigated the case.

In a subsequent search of the defendant’s home, OPD officers discovered thousands of images and three videos of graphic, amateur child pornography featuring young boys from infancy to early teens.

The Orange County District Attorney’s Office filed charges against Needham for the molestation and possession of child pornography. The U.S. Attorney’s Office later assumed the child pornography case, as the defendant’s maximum sentence if convicted would be greater than if prosecuted at the state level.

In February 2012, Needham was sentenced to nine years in federal prison for the child pornography case. His 6-year sentence for the child molest in Orange County will be served concurrent to the federal sentence.

Needham’s lifetime sex offender registration bars him from entering County recreational areas and City parks that have passed the Sex Offender Ordinance. San Bernardino Middle School Teacher Arrested for Receipt and Distribution of Child Pornography

RUNNING SPRINGS, CA—A former San Bernardino middle school teacher was arrested this morning on charges he exchanged sexually explicit images online with a 13-year-old girl, announced Steven Martinez, assistant director in charge of the FBI’s Los Angeles Field Office; and André Birotte Jr., the United States attorney in Los Angeles. The announcement was made on behalf of multiple law enforcement agencies investigating the case in California and New Jersey.

Eugene Ballantyne, 29, of Running Springs, California, was arrested this morning without incident by FBI agents. A criminal complaint was filed in United States District Court in Riverside on Friday charging Ballantyne with receipt and distribution of child pornography, a violation of Title 18, United States Code, Section 2252A(a)(2).

According to the complaint, detectives with the South Brunswick Police Department in New Jersey were contacted by a parent of a 13-year old-girl, the alleged child victim identified in the complaint as “CV,” after the parent had become aware of sexually explicit communication between the victim and Ballantyne earlier this year. South Brunswick detectives continued to investigate and contacted the FBI when their investigation revealed the victim had been corresponding with a suspect located in California.

Investigators in New Jersey and California, with the assistance of the San Bernardino School District, identified Eugene Ballantyne as the user of the phone used to communicate with the minor victim.

Substitute Teacher Charged with Misdemeanor Child Molesting

DOWNEY – A substitute teacher was charged by the District Attorney’s Office today with one misdemeanor count of child molesting earlier this month at a La Mirada middle school.

Ted Nishihara, 29 (dob 4-17-1982), was expected to appear for arraignment this afternoon in Department 5, Downey Superior Court. He was charged with the single count in case No. 2DY01338. Bail was recommended at $20,000.

The complaint stated that the alleged crime occurred on March 2. The victim was identified only as Jane Doe.

Authorities said Nishihara was a substitute teacher at Los Coyotes Middle School in La Mirada when the alleged crime occurred.

Three Individuals Sentenced to Prison for Participating in International Child Pornography Ring

WASHINGTON—Three men were sentenced to prison today in Los Angeles for their participation in an international child pornography ring, announced Assistant Attorney General Lanny A. Breuer of the Justice Department’s Criminal Division, U.S. Attorney André Birotte Jr. of the Central District of California, and Assistant Director in Charge Steve Martinez of the FBI’s Los Angeles Field Office.

Andrew Neil Scott, 31, of Flint, Michigan, was sentenced to 30 years in prison followed by lifetime supervised release. Scott pleaded guilty on December 2, 2010 to participating in a child exploitation enterprise and two counts of production of child pornography.

Woodrow Tracy, 68, of Sun Valley, California, was sentenced to 96 months in prison followed by lifetime supervised release. Tracy pleaded guilty on September 21, 2010 to conspiracy to transport child pornography.

Justin Lee, 34, of League City, Texas, was sentenced to 66 months in prison followed by lifetime supervised release. Lee pleaded guilty on September 7, 2010 to conspiracy to advertise, receive, distribute, solicit and possess child pornography.

Ex-Con Sentenced for Sexually Assaulting a Redondo Beach Student

TORRANCE – An ex-con was sentenced today to 18 years to life in prison for the 2003 sexual assault of a 17-year-old Redondo Beach girl at knifepoint, the District Attorney’s office announced.

Sylvester Gene Rawls, 47, was sentenced by Judge James Branlon after a jury in February found him guilty of two felony counts of forcible oral copulation with the special allegation that he personally used a deadly weapon, a knife, said Deputy District Attorney Christi Frey.

Rawls attacked a female student in a campus bathroom at Redondo Union High School on Aug. 28, 2003. In December 2010, a DNA hit identified Rawls as the suspect after his DNA was collected following a federal conviction of conspiracy to manufacture PCP.

MAN CONVICTED OF FORCING TWO WOMEN TO PERFORM SEX ACTS AFTER THREATENING THEM WITH A WEAPON AND ASSAULTING A THIRD WOMAN

SANTA ANA - A man was convicted today of forcing two women to perform sex acts on him after threatening them with a weapon and assaulting a third woman. Rulin Hernandez Loaeza, 24, Garden Grove, was found guilty by a jury of two felony counts each of forcible oral copulation and criminal threats, one misdemeanor count of physical assault and a sentencing allegation for sexual crimes against multiple victims. Loaeza faces a minimum sentence of 15 years to life in state prison. His sentencing is scheduled for May 4 2012, at 9:00 a.m. in Department C-27, Central Justice Center, Santa Ana.

At approximately 6:00 p.m., on Nov. 3, 2009, Loaeza offered 19-year-old Jane Doe #1 a ride home after meeting her outside of a store in a Garden Grove. Loaeza drove the victim in his 4-door sedan to a secluded area and parking. Loaeza then pulled out a weapon and threatened to kill Jane Doe #1 if she did not orally copulate him. After performing the sex act, the victim was able to flee. Jane Doe #1 reported the assault to police.

At approximately 10:30 p.m., on Nov. 18, 2009, Loaeza picked up Jane Doe #2 in Stanton. Loaeza drove the victim in his car to a desolate area and parking. Loaeza then pulled out a weapon and threatened to kill Jane Doe #2 if she did not orally copulate him. An Orange County Sheriff’s deputy drove by Loaeza’s parked car in his patrol car and pulled over after noticing suspicious activity occurring inside the vehicle. Loaeza was arrested at the scene.

At approximately 11:30 p.m., on Dec. 6, 2007, Loaeza followed Jane Doe #3 to the back of her house after she returned home late from work. Loaeza grabbed Jane Doe #3 by the back of her hair as she was opening the door to her home. Jane Doe #3 screamed for help and Loaeza fled the scene. The victim and a family member tried to follow Loaeza but lost sight of him and reported the crime to a nearby police officer.

Fugitive Returned from Mexico to Stand Trial in Child Sex Abuse Case

POMONA – A 32-year-old man extradited from Mexico on child
sex abuse charges appeared in court today, the District Attorney’s Office announced.

Roberto Edgar Torres (dob 6/14/79), who arrived in Los Angeles on March 2, appeared in Pomona Superior Court for arraignment but
the hearing was postponed until April 10. The defendant is charged
in case No. KA086731.

Torres is charged with two counts each of sex and/or sodomy with a child under 10 and oral copulation and/or sexual penetration with a child under 10. He also faces one count each of lewd act upon a child and sending harmful matter.

The complaint includes special allegations that the abuse involved multiple victims and that the defendant used obscene matter and matter depicting sexual conduct.

The charging document further indicates that the victims were a boy and a girl and that the alleged offenses took place between January 1997 and March 2009.

The female victim was 7 years old at the time of the purported molestation. The male victim, who at the time of the alleged offenses was around 7 or 8 years old, is now an adult, prosecutors said.

Torres fled during the investigation and was not arrested in connection with the alleged crimes until authorities apprehended him in Tamaulipas, Mexico in September 2011. The case was filed for warrant in May 2009. Officers of the Pomona Police Department investigated the case.

If convicted as charged, Torres faces a maximum term of 110 years to life in state prison.

Scott Andrew Christensen, 28, Rancho Santa Margarita, is charged with three felony counts of lewd acts on a child under the age of 14 years with sentencing enhancement allegations for substantial sexual conduct with a child and committing the sexual acts against more than one victim. If convicted on all charges, Christensen faces a maximum sentence of 45 years to life in state prison. Opening statements are expected to begin Monday, March 5, 2012, at 9:00 a.m. in Department C-37, Central Justice Center, Santa Ana.

At the time of the crimes, Christensen was a 6-year employee as a Child Care Leader at The Learning Connection (TLC), an after-school daycare program hosted by the Saddleback Valley Unified School District at elementary schools in Southern California.

On two occasions between Sept. 1, 2005, and Aug. 7, 2006, Christensen is accused of sexually assaulting John Doe #2 when he was 5 to 6 years old. He is accused of touching the victim’s buttocks and side of his penis while the students were watching a movie.

On one occasion between May 6, 2000, and Aug. 1, 2004, Christensen is accused of sitting next to John Doe #3 during a movie while the lights were off. He is accused of grabbing Doe #3’s wrist and putting the victim’s hand down the front of the defendant’s pants, underneath his underwear.

MAN LINKED THROUGH DNA FACES TRIAL FOR 1988 COLD CASE SEXUAL ASSAULT-MURDER OF YOUNG PREGNANT NEWLYWED IN 1988

SANTA ANA - A man faces trial Monday for the 1988 cold case sexual assault-murder of a pregnant 22-year-old newlywed after being linked to the crime through DNA. Jason Balcom, 41, is charged with one felony count of special circumstances murder in the commission of a rape, sodomy, robbery, and burglary. The District Attorney is seeking the death penalty in this case. Opening statements are expected to begin Monday morning, March 5, 2012, in Department C-45, Central Justice Center, Santa Ana. The time is to be determined.

In July 1988, 22-year-old Malinda Gibbons and her husband Kent Gibbons moved to Costa Mesa from Utah. On the morning of July 18, 1988, Kent Gibbons left for work and Malinda Gibbons, who was between four and six weeks pregnant, stayed home to unpack in their new apartment.

While Malinda Gibbons was home alone, Balcom is accused of entering her apartment and binding the victim’s hands and feet using Kent Gibbons’ neck ties. He is accused of raping and sodomizing Malinda Gibbons and then murdering her by stabbing her in the chest. Balcom is accused of stealing the victim’s purse and wedding ring from her finger and fleeing the scene.

At the time of the murder, Balcom is accused of living with his mother and aunt on the same street as the Gibbons only a quarter of a mile south of their home.

Kent Gibbons returned home from work to find his wife brutally murdered with her pants down around her ankles. The Costa Mesa Police Department investigated this case and collected evidence from the scene, including semen on the carpet, the victim’s thigh, and in her anus. The case went cold.
